In 1995, the Montana Legislature enacted “tort reform” that now makes it impossible for any medical malpractice victim and his family members, no matter how severe the injury, to recover more than $250,000 from a jury for all forms of noneconomic damages. We do not believe this law is constitutional. Therefore, our medical malpractice attorneys are in the process of mounting a challenge to this law through the court system.
